Terms of Service

These Terms of Service ("Terms") govern your use of showcasewebdesigns.net and the services provided by Buckley Studios, LLC, operating under the trade name Showcase Web Designs ("we," "us," or "our"), located at 6306 North 131st St, Omaha, NE 68164.

By using our website, submitting a design request, or entering into a service agreement with us, you agree to these Terms. If you do not agree, do not use our services.

This document is a draft for informational purposes and should be reviewed by a qualified attorney before relying on it as a binding legal instrument.

Showcase Web Designs provides the following categories of services:

• Custom website design and development for businesses, organizations, and individuals
• Personal and occasion websites (weddings, events, portfolios, and similar)
• Ongoing website management, maintenance, and content updates
• Support for existing websites (fixes, improvements, and migrations)
• Custom software solutions, including mobile apps, IoT integrations, and small-scale server-side applications

The specific scope of services for each project is agreed upon before work begins. Features, timelines, and deliverables are documented in a project proposal or agreement provided to you separately.

Active clients may be granted access to a client portal where they can manage their account, view invoices, request changes, and manage customization preferences. Accounts are provisioned by Showcase Web Designs and are not self-registered.

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your login with others and to notify us immediately if you suspect unauthorized access.

We reserve the right to suspend or terminate portal access if we reasonably believe an account is being misused or if the associated service agreement has ended.

Pricing estimates provided through our website (including the design-request form) are indicative only and are based on the information you supply. Final pricing is confirmed after reviewing your specific requirements, mockup approval, and a signed agreement.

Monthly management and hosting fees, if applicable, are billed in advance for the upcoming month of service. Fees are subject to change with reasonable advance notice.

Invoices are issued by Buckley Studios, LLC and payable to Showcase Web Designs. Accepted payment methods include:

• Credit or debit card via Stripe (secure, encrypted processing)
• Check made payable to Buckley Studios, LLC and mailed to 6306 North 131st St, Omaha, NE 68164
• Cash, by arrangement — contact us to schedule

Payment is due by the date specified on the invoice. Late payments may result in a pause of services until the balance is resolved. We reserve the right to charge reasonable late fees on overdue balances.

Refund eligibility depends on the stage of work and the terms of your individual project agreement. As a general policy:

• Deposits paid to initiate a project are non-refundable once work has begun
• Monthly management fees are non-refundable for the current billing period
• If we are unable to deliver agreed services due to our own failure, we will work with you on a fair resolution

To cancel a service, contact us in writing at nick@showcasewebdesigns.net. Cancellation does not entitle you to a refund of amounts already paid unless otherwise agreed.

To allow us to deliver services effectively, you agree to:

• Provide accurate and complete information about your project, business, and requirements
• Respond to requests for feedback, approvals, and content in a timely manner
• Ensure that any content, images, logos, or materials you provide are owned by you or that you have the right to use them
• Notify us promptly of changes that affect your project or account

Delays caused by late client feedback or failure to provide required content may affect project timelines and are not our responsibility.

Upon receipt of full payment, you own the final website files and custom design assets created specifically for your project. This does not include:

• Third-party code, libraries, or frameworks (which remain subject to their own licenses)
• Pre-existing components, templates, or tooling created by Showcase Web Designs that are reused across projects
• Stock imagery or fonts licensed for specific use (rights are as permitted by those licenses)

We retain the right to display your completed project in our portfolio unless you explicitly request otherwise in writing.

Content, logos, and materials you provide remain your intellectual property. By providing them, you grant us a limited license to use them solely for delivering your project.

Revision rounds included in a project are specified in your project agreement. Requests for changes beyond the agreed scope may be quoted as additional work.

We will provide estimated timelines when agreeing on a project. Timelines are estimates and may be affected by the complexity of your requests, delays in receiving client materials, or other factors outside our control. We will communicate any material delays promptly.

To the maximum extent permitted by applicable law, Buckley Studios, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, including but not limited to loss of revenue, data, or business opportunities.

Our total liability for any claim related to our services is limited to the amount you paid us for the specific service giving rise to the claim in the three months preceding the claim.

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts of Douglas County, Nebraska.

Before initiating any legal action, you agree to contact us in good faith to attempt to resolve the dispute informally at nick@showcasewebdesigns.net.

We may update these Terms from time to time. We will revise the "Last updated" date when we do. Continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
